Introduction

Agreement to These Terms

These Terms and Conditions ("Terms") govern your use of the Hi-Tech Engineering website at hitechengineering.co.za and all services provided by Hi-Tech Engineering (Pty) Ltd ("Hi-Tech Engineering", "we", "us", or "our").

By accessing our website, submitting an enquiry, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our website or services.

Please read these Terms carefully. They contain important information about your rights and obligations, including limitations of liability and dispute resolution procedures.

Use of Our Website

You may use our website for lawful purposes only. You agree not to:

  • Use the website in any way that violates applicable South African or international laws or regulations
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Knowingly introduce viruses, trojans, worms, or other malicious or harmful material
  • Attempt to gain unauthorised access to any part of our website or its related systems
  • Reproduce, duplicate, copy, or resell any part of our website content without our express written permission
  • Scrape, harvest, or extract data from our website in an automated or unauthorised manner

We reserve the right to suspend or terminate access to our website for users who violate these Terms.

Quotations and Service Engagements

All quotations provided by Hi-Tech Engineering are subject to the following conditions:

  • Quotations are valid for 30 calendar days from the date of issue unless otherwise stated in writing
  • A quotation does not constitute a binding agreement until accepted in writing by the client and confirmed by Hi-Tech Engineering
  • Prices quoted are exclusive of VAT unless expressly stated otherwise
  • Quotations are based on information provided at the time of quoting; material changes to scope may result in revised pricing
  • Emergency call-out rates and after-hours service rates apply outside of standard business hours

Work will only commence upon receipt of a signed acceptance of quotation or written purchase order. Hi-Tech Engineering reserves the right to decline any request for service at its discretion.

Payment Terms

Unless a separate written credit agreement exists between the parties:

  • Payment is due 30 days from invoice date ("net 30")
  • We reserve the right to require a deposit prior to commencement of work, particularly for large or material-intensive projects
  • Invoices not settled by the due date may attract interest at the rate prescribed under the National Credit Act or as stipulated in your service agreement
  • Hi-Tech Engineering reserves the right to suspend services on accounts in arrears until all outstanding amounts are settled
  • All prices are quoted in South African Rand (ZAR) and are subject to VAT at the current applicable rate

Disputed invoices must be raised in writing within 7 days of the invoice date. Raising a dispute does not entitle the client to withhold payment of the undisputed portion of an invoice.

Service Level Agreements

Where a Service Level Agreement (SLA) has been entered into between Hi-Tech Engineering and a client, the terms of that SLA shall take precedence over these general Terms in respect of the services covered by the SLA.

Adhoc and term-based SLAs are available. Term-based SLAs attract preferential service levels and pricing. Emergency and after-hours call-out services are subject to availability and applicable rates as agreed in your SLA or as quoted at the time of the call-out.

Workmanship Warranty

Hi-Tech Engineering warrants that all work performed by our technicians will be carried out in a professional and workmanlike manner in accordance with applicable industry standards and regulations.

  • Workmanship is warranted for a period of 90 days from the date of completion of the relevant work, unless otherwise agreed in writing
  • Equipment and materials supplied are subject to the manufacturer's warranty; Hi-Tech Engineering will assist in lodging warranty claims where applicable
  • Warranties are void where equipment has been tampered with, misused, incorrectly operated, or damaged by a party other than Hi-Tech Engineering
  • Certificates of Compliance (CoC) for electrical installations are issued in accordance with the Occupational Health and Safety Act and applicable SANS standards

This warranty does not affect your statutory rights under the Consumer Protection Act 68 of 2008.

Limitation of Liability

To the maximum extent permitted by South African law:

  • Hi-Tech Engineering's total liability to you for any claim arising out of or in connection with our services shall not exceed the value of the specific service giving rise to the claim
  • We shall not be liable for any indirect, consequential, special, or punitive damages, including loss of profit, loss of revenue, or loss of data
  • We are not liable for delays or failures caused by circumstances beyond our reasonable control, including load shedding, natural disasters, civil unrest, or supplier failures (force majeure)
  • Access to and use of our website is at your own risk; we make no warranties as to the accuracy, completeness, or availability of website content

Important: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable South African law, including the Consumer Protection Act.

Client Obligations

When engaging Hi-Tech Engineering for services, you agree to:

  • Provide accurate, complete, and timely information required for the performance of the services
  • Ensure safe and reasonable access to premises and equipment for our technicians
  • Obtain all necessary approvals, permits, and consents required for the work to be performed
  • Notify Hi-Tech Engineering of any health, safety, or environmental hazards present at the site prior to commencement of work
  • Not engage or permit other contractors to interfere with or work on the same systems during the period of our engagement without prior written agreement
  • Pay all amounts due in accordance with the agreed payment terms

Health and Safety

Hi-Tech Engineering operates in compliance with the Occupational Health and Safety Act 85 of 1993 and its regulations. Our technicians are trained to maintain safe working practices on all sites.

Clients are responsible for ensuring that their sites comply with applicable health and safety legislation. Hi-Tech Engineering reserves the right to refuse or suspend work at any site where conditions pose an unreasonable risk to the health and safety of our employees or subcontractors.

Intellectual Property

All content on this website — including text, images, graphics, logos, designs, drawings, technical documentation, and software — is the property of Hi-Tech Engineering or its licensors and is protected by South African and international intellectual property law.

You may not reproduce, distribute, modify, or create derivative works from any website content without our prior written consent. Technical drawings and designs produced by Hi-Tech Engineering for a specific project remain the intellectual property of Hi-Tech Engineering unless otherwise agreed in writing.

Privacy and Personal Information

The collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using our website or services, you consent to the processing of your personal information as described in our Privacy Policy in compliance with the Protection of Personal Information Act 4 of 2013 (POPI Act).

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the South African courts.

Prior to instituting formal legal proceedings, the parties agree to attempt to resolve any dispute amicably through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may refer the matter to mediation before proceeding to litigation.

Hi-Tech Engineering's registered head office in Bloemfontein, Free State shall be the agreed jurisdiction for all legal proceedings unless otherwise required by applicable law.

Consumer Protection Act

Where you engage Hi-Tech Engineering as a consumer as defined in the Consumer Protection Act 68 of 2008 (CPA), you retain all rights afforded to you under the CPA. Nothing in these Terms is intended to limit, exclude, or modify your statutory consumer rights.

In particular, you have the right to:

  • Receive services of acceptable quality
  • Be informed of the nature, price, and terms of services before engaging them
  • Fair, honest, and reasonable dealings
  • Hold us accountable for implied warranties in respect of services rendered

Changes to These Terms

Hi-Tech Engineering reserves the right to amend these Terms at any time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our website or services after any such change constitutes your acceptance of the new Terms.

For material changes, we will endeavour to provide reasonable notice where practical.
